These terms govern your use of BestPrompter (bestprompter.com), operated by BestPrompter, 1458 3rd Street, San Francisco, California 94158, USA. By creating an account or using the service, you agree to them. If you do not agree, do not use the service. (“BestPrompter” is the operating name; replace with the registered legal entity if the service is incorporated separately.)
1. What the service is
BestPrompter is a prompt-optimization service. You submit a prompt, or describe what you need a prompt to do, and we return an improved prompt:
- Standard mode — a fast, single-pass optimization with explained changes. Standard results are labeled “not validated”: no real task execution has been performed.
- Deep mode — an iterative optimization that runs your prompt on target models, evaluates the outputs, and returns evidence with an honest strength label (exploratory, directional, or validated).
To do this, we forward your prompts to third-party model providers using our own API keys. The providers we use are disclosed in the product; see the privacy policy for how your data is handled.
2. Accounts
You must register to use the service (email and password, or Google/GitHub sign-in). You agree to provide accurate information, keep your credentials secure, and not share your account. You are responsible for activity under your account. You must be at least 16 years old.
3. Plans, limits, and billing
- Free tier. Free accounts receive a Standard-only allowance of 3 units per day and 10 units per month. Results from free auto-runs are published anonymously and listed in the public Explore gallery by default — see section 5.
- Paid plans. Paid plans are monthly subscriptions with daily and monthly unit limits. Limits reset at the start of each day and each billing month respectively. Unused units do not roll over. Limits are counted in units: a Standard run consumes 1 unit and a Deep run consumes 5, with the cost shown before each run starts. Current plans: Plus ($3.99/month — 10 units/day, 200/month, Deep included) and Pro ($19.99/month — 50 units/day, 1,000/month, Deep included). Current pricing is always shown at bestprompter.com/pricing.
- Cost transparency. Before a Deep run starts, we show a cost estimate and a budget cap. Billable Deep work does not proceed on an assumed answer — it requires your explicit go-ahead or a budget you pre-authorized.
- No charge on failure or refusal. Runs that error, are cancelled, or end in an honest low-confidence refusal (“we could not validate this”) do not count against your plan limits. You pay for delivered work, not for attempts.
- Refunds. [TBD: refund policy for counsel and product review. Any 14-day refund language is a proposed policy only and must not be published as final until approved.] There is no annual plan at this time; subscriptions are billed monthly.
- Changes to plans. We may change plan pricing or limits with reasonable advance notice; changes apply from your next billing cycle.
4. Your content
You own your content. Prompts and descriptions you submit, and the optimized prompts and results generated for you, are yours. We claim no ownership over them.
License to us. You grant us a limited, worldwide, non-exclusive license to store, process, transmit, and display your content solely as needed to operate and provide the service — including sending prompts to model providers, generating results, maintaining your history and bookmarks, and rendering public pages you have published. We do not use your content to train or improve our systems unless you opt in (see the privacy policy). This license ends when your content is deleted, except for public pages you have published (see section 5) and residual copies covered by the deletion schedule in the privacy policy.
Your responsibility. You must have the right to submit the content you submit. Do not submit content you are not permitted to share with us and our model providers (for example, someone else’s confidential information).
5. Public sharing
- Free auto-run results are published as anonymous public pages and listed in the Explore gallery by default. Anyone can view, copy, and fork a public prompt. Public pages do not show your identity.
- Paid-tier results are private by default and become public only when you share them.
- Paid-tier or manual public pages are revocable: revoking, regenerating the link, deleting the underlying session, or deleting your account takes the page down immediately (the URL returns “410 Gone”).
- Free auto-run public pages remain public and listed while your account remains active. In the current version, free users cannot directly revoke the page or delete the underlying session as a removal path; deleting your account is the user-controlled way to remove free auto-run public pages.
- You are responsible for what you publish. Do not publish content that is unlawful, infringes others’ rights, or violates the acceptable use policy. We may take down public pages that do.
6. Acceptable use
Your use of the service is subject to our acceptable use policy, which is part of these terms. In short: no illegal content, no abuse of the service or of other users, no evading limits, and no using our platform as a proxy to violate model providers’ policies.
7. Disclaimers
Please read this section carefully — it reflects how the product actually works.
- LLM outputs can be wrong. Optimized prompts, explanations, scores, and evaluations are generated by large language models and may be inaccurate, incomplete, or unsuitable for your purpose. Review results before relying on them.
- “Not validated” means not validated. Standard results have not been executed or evaluated on real tasks. Deep results carry an evidence label (exploratory, directional, or validated) that states how strong the evidence actually is — an “exploratory” label is not a guarantee of quality.
- No warranty. The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any prompt will perform on your target model.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. Our total aggregate liability for claims relating to the service is limited to the amount you paid us in the 12 months before the claim arose (or, for free accounts, USD 100). Nothing in these terms excludes liability that cannot be excluded by law.
9. Suspension and termination
You can stop using the service and delete your account at any time; deletion follows the schedule in the privacy policy. We may suspend or terminate your account if you materially breach these terms or the acceptable use policy, if required by law, or to protect the service or other users. Where reasonable, we will notify you and give you a chance to remedy the issue. On termination, active public pages are revoked and your data is handled per the privacy policy.
10. Changes to these terms
We may update these terms as the service evolves. For material changes we will give notice in the product before they take effect. Continued use after the effective date means you accept the updated terms.
11. Governing law and disputes
- These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules.
- The state and federal courts located in San Francisco County, California have exclusive jurisdiction over disputes relating to these terms or the service. No mandatory arbitration provision applies at this time.
